HireVue discontinued facial expression analysis technology using Affectiva’s emotion recognition software in 2021. The company had deployed the feature for several years to generate employability scores weighting nonverbal cues from video interviews for over 700 enterprise clients. In 2023 the ACLU filed a complaint with the Colorado Civil Rights Division against Intuit and HireVue after research showed the AI system performed significantly worse on deaf, hard-of-hearing and non-white speakers. The same underlying technology architecture that infers characteristics from behavioral data correlating with protected conditions is now commercially available for post-hire performance monitoring.
