Job seekers Erin Kistler and Sruti Bhaumik filed the class action lawsuit against Eightfold AI on January 21, 2026, in Contra Costa County Superior Court on behalf of a nationwide class. The suit claims Eightfold compiled secret consumer reports scoring applicants 0-to-5 on likelihood of success using data from over 1 billion profiles without required FCRA disclosures, authorizations, or dispute mechanisms. Plaintiffs applied via Eightfold-powered job URLs but received no interviews or notices. Eightfold serves Microsoft, PayPal, Salesforce, and Bayer, with one-third of its customers being Fortune 500 companies. Eightfold spokesperson Kurt Foeller responded that the platform uses data shared by candidates or customers and does not scrape social media.
